WHat’s mediation?
What’s mediation? Family law mediation is a confidential out-of-court process that helps parties work together to resolve all the issues involved in their court case. Such issues may include parenting/custody arrangements, division of assets (such as real estate, investment accounts, and retirement benefits), allocation of debts, and child and spousal support (alimony). The role of the mediator is to facilitate this process, brokering or negotiating a win-win agreement.
The court may order that you participate in mediation, or your attorney may recommend mediation. The meeting is informal but conducted in a safe and structured setting, including virtually via Zoom. Mediation is a lot less stressful than going to court. Discussions in mediation are confidential. What the couple talks about cannot be brought up later in court or anywhere else.
